Anne Stephenson will look at recent Probate Office changes in detail, whilst providing helpful precedents for new Oaths and Bonds.  She will then go onto look at how case law is forcing a new approach to probate litigation before addressing the new approach being taken to the term “missing” with the commencement of the Civil Law (Presumption of Death) Act 2019. 

Padraic Courtney will examine the application of Section 150 of the Legal Services Regulation Act 2005 from a Probate perspective.  

Ciara Cahill will discuss the recently launched online charitable bequests form. 

Trea McGuinness, Deputy Chair of DSBA Probate & Tax Committee, will chair this seminar.

SPEAKERS

ANNE STEPHENSON

Principal of Stephenson Burns Solicitors. She is a member of; STEP, the DSBA Probate and Taxation Committee, the Probate Liaison Committee. She is a founder member of Solicitors for the Elderly and Vice Chair of the Law Society’s Probate Administration and Trust Committee She lectures, examines and tutors on the Law Society's Professional Courses (PPC 1 & 11) on the Wills Trusts, Probate, Tax Planning and Conveyancing Modules and on the STEP Diploma in Wills, Trust & Estate Planning. She also lectures for CPD, Skillnets, the DSBA, STEP Ireland SFE and for regional Bar Associations and other professional bodies. She is the co-author of the Oxford University Press (OUP) Manual on "Wills Probate and Estates" 6th Edition, and the OUP Manual on “Conveyancing”, 8th Edition and the co-author of OUP Manual on “Capital Taxation” 2nd edition. She is a contributor to “Laffoy Irish Conveyancing Precedents”- executors and administrators. She also contributes to the Law Society Gazette, the Parchment, and the Irish Tax Review. Anne leads the successful bi-annual Stephenson Solicitors’ Seminar series which is in its 20th year, and regularly attracts large numbers of professional and institutional attendees to consider issues of interest in the field of Wills, Trusts Estate Law and Probate and Capital Taxes.

PADRAIC COURTNEY

Padraic qualified as a solicitor in 1994 and has worked for the Law Society’s Law School as a course manager, specialising in Probate and Taxation, for more than twenty years. He holds the Law Society Diploma in Property Tax. A registered Trust and Estate Practitioner and former Committee member of STEP Ireland, he is the current chair of SFE Ireland and secretary to the Law Society of Ireland Probate, Administration and Trusts Committee. He has lectured and tutored on Probate and Tax at PPC I and II levels, and has delivered seminars for CPD, Skillnets, the DSBA, STEP Ireland, and regional Bar Associations. He runs the Enduring Powers of Attorney, the Wills, Probate, Tax and Estates, the Probate Practice & Procedure and the Wills Drafting Masterclasses offered by Law Society Professional Training.

CIARA CAHILL:

Ciara Cahill is Legal Advisor to the Charities Regulator since August 2015. Ciara is also Head of the Charity Services function which provides services to charities pursuant to the Charities Act 1961. Ciara previously worked as an in-house legal advisor in the private sector for over 7 years. Ciara is a solicitor and member of STEP.
