The aim of this seminar is to provide an insight into the practical implications of the Employment (Miscellaneous Provisions) Act 2018, which comes into effect on 4 March 2019, and to provide guidance from our expert panel of speakers on dealing with internal investigations before wrapping up the morning on the topic of no fault dismissals. 


Marguerite Bolger SC - will provide an informative overview of workplace investigations in light of the McKelvey decision and other relevant case law. Her session will also give useful pointers on how best to deal with such investigations, including the court’s current view on the right to cross examination and legal representation during such investigations.


Des Ryan BL – will provide a timely overview of the Employment (Miscellaneous Provisions) Act 2018 and he will cover the topic of no fault dismissals and injunctions in the context of harassment type allegations in light of the recent High Court decision of Grenet v Electronic Arts Ireland Limited [2018] IEHC 786 (21 December 2018).


Chair: Duncan Inverarity

Duncan is the head of A&L Goodbody’s Employment Law Group with considerable experience in this area having practiced exclusively in employment law in multiple jurisdictions advising public and private sector employers on both contentious and non-contentious matters.  He advises boardrooms across Ireland and abroad on both strategic and complex employment and industrial relations matters as well as public sector clients. Duncan specialises in crisis management for clients and has advised on some of the most significant corporate issues in Ireland. 


Marguerite Bolger SC is a Senior Counsel specialising in employment law and has appeared in many of the key employment cases before the Irish and European Court.  She is a founder member and former Chairperson of the Employment Bar Association of Ireland, the former Vice Chairperson of the Incorporated Counsel for Law Reporting of Ireland and a member of the Editorial Boards of the Irish Employment Law Journal and the Employment Law Reports.  Marguerite lectures, comments and publishes extensively on employment law, including “Employment Equality Law (2012, Roundhall Thompson Reuters) and a contributing author to Employment Law (ed. Regan & Murphy, 2017 Bloomsbury Professional). 


Des Ryan BL – Des is a practising Barrister specialising in employment law.  He has many years of experience acting for both employer and employee clients whom he advises on all aspects of employment law.  He regularly appears before the WRC and the Labour Court as well as before the Superior Courts.  He is an Associate Professor and Fellow at Trinity College, Dublin and is very experienced in lecturing in employment law and related areas.  He has contributed to a number of publications concerning employment law and is the author of the new edition of Redmond on Dismissal Law (2017) as well as the co-author of the textbook "Employment Law in Ireland” (2009).  He regularly gives CPD lectures to colleagues in both the solicitors and barrister’s profession, to the judiciary and to human resources professionals.
