Legal Services Regulation Act

Dear Members and Colleagues

The DSBA continues to monitor the steps towards implementation of the substantive provisions of the Legal Services Regulation Act 2015.

It has been over a year now since the Legal Services Regulatory Authority was established, with much of the past year spent by the Authority on the consultations required under the 2015 Act and putting operational infrastructure in place for the Authority as an organisation.

A new Chief Executive has recently been appointed to the Authority, Mr Brian Doherty B.L., and with whom the DSBA has had an initial  meeting.

The DSBA continues to engage with the Authority on implementation of the 2015 Act,  with our focus being on key topics to include:

business structures for solicitors;
legal costs;
practice complaints;
regulatory fees;

The DSBA continues to advocate for the early introduction of Limited Liability Partnerships, given not least that LLP is expressly provided for in the 2015 Act and does not involve the creation of any new legal/corporate entity in order to operate – just registration of a firm of solicitors with the Authority. The ability for solicitors to practice through a company also remains firmly in our focus.

As regards timing of the above, this remains very much an open question – a case of watch this space.
