The aim of this seminar is to educate attendees about mediation generally and mediation in practise - by means of a DVD role-play - and the role of solicitors in that practise. Mediation is fast being introduced, both in legislation as well as in practise, as not just an alternative dispute resolution method but a first choice method of dispute resolution especially where the future ongoing relationship between the parties to the dispute is a real issue.

John O’Connor will compare the different methods of dispute resolution and their approach to problem solving and review recent case law and developments on mediation in UK and Ireland including the Law Reform Commission Consultation paper on ADR and the recent EU Directive on Mediation.

Julie McAuliffe will speak about what happens to communication between parties who are in conflict with one another and how to understand one’s own conflict style. She will outline the basic working principles and stages of mediation and where and when mediation and conflict coaching can best be used.

John and Mary Condell will talk of the challenges for solicitors involved in mediation and how to prepare themselves and their clients for it. Mary will outline the various mediation models and their appropriateness for disputes ranging from employment matters to family separation or succession disputes to commercial or community disputes. Mary will introduce the DVD (of a Succession Act Section 117 dispute) showing the mediation process in practise and specifically the solicitor’s role in it.

SPEAKERS
JOHN O CONNOR
John qualified as a solicitor in 1980 and is the principal of John O Connor solicitors. He is a Fellow of the Institute of Arbitrators and an accredited mediator with CEDR (the London based Centre for Effective Dispute Resolution) and a certified member of the Mediators Institute of Ireland . A past president of the DSBA and Past Chairman of the STEP Irish Branch he is currently a member of the Council of the Law Society of Ireland and of the STEP world

JULIE MCAULIFFE
Julie McAuliffe is an accredited practitioner mediator of the Mediators Institute of Ireland since 1999 and has worked full time in this field since. She obtained a Masters Degree in Mediation and Conflict Resolution in 2005 from UCD. Julie is the Director of Conflict Positive which offers Mediation, Conflict Coaching and Mediation Training. In addition to her own practice Julie also works for the Family Mediation Service and the Clanwilliam Institute of Family Therapy. She mediates complex multi party disputes, as well as interpersonal misunderstandings, bullying and harassment issues and family disputes.

Julie teaches mediation at UCD, NUI Maynooth, The Institute of Public Administration and has provided mediation lectures in the Law Courts. She trains organisations, professionals and individuals in mediation. Julie has served on the Mediator’s Institute of Ireland Executive Board and as Registrar with the Mediators Institute Ireland

MARY CONDELL
Mary qualified as a solicitor in 1978 and has been with Porter Morris & Co since 1992. She is a certified member of the Mediator’s Institute of Ireland (MII) and current Chairperson of STEP in Ireland. She is a regular lecturer for the Law Society to both students and solicitors on capital taxation and lectures also on mediation including the presentation of a workshop to the 2009 Annual Conference of the MII on the role of solicitors in mediation.
