Keith Walsh, Solicitor will talk to attendees on family law procedures in the District Court. He will explain how family law matters are different and will focus on the practical day to day issues that solicitors’ in the family law courts face. In addition, Keith will be providing attendees with a booklet of precedents on the more common types of District & Circuit Court applications and will analyse in detail:
District Court applications for access, custody, guardianship and maintenance
Applying for or defending domestic violence applications – safety and barring orders
as well as dealing with breaches of these orders
Running a District Court family case from start to finish
Legal aid in the District and Circuit Court – the private practitioners schemes
Justin Spain, Solicitor will discuss Family Law at Circuit Court on a very practical level. He too will be provide a booklet of precedents and will analyse the following;
Obtaining Judicial Separation and Divorce
Making interim applications and tactical considerations relating to this
Affidavit of Means and Welfare – how to prepare and then how to scrutinise
Discovery – whether to apply and how to manage time effectively
Pension Adjustment Orders – Under what circumstances should they be sought and
is it worth it?
Rachel Murphy, Solicitor will discuss alternative methods of dispute resolution in family law and how one might expand their practice in this regard. She will outline both Collaborative Family Law and Lawyer Assisted Mediation and under the following headings;
What it is and how it works
Training and qualification
The advantages and disadvantages from client perspective and from solicitor’s
perspective
Does it produce results?
SPEAKERS
Keith Walsh
Keith has worked in the area of family law since he qualified in 2001. He is a former Chairman of the DSBA’s family law committee and current Vice Chairman. He has written on family law matters for the Gazette and the DSBA’s Parchment. He practices family law mainly in the District and Circuit Courts and occasionally in the High Court and is actively involved in Collaborative Family Law and a member of the Dublin practice group.
Justin Spain
Justin qualified as a Solicitor in 1994. He specialises in the area of family law and is in practice with Hayes Solicitors. He is Secretary of the Dublin Solicitors Bar Association’s Family Law Committee and is a member of the Executive Committee of the Family Lawyers Association. Justin is also admitted as a Solicitor in England and Wales and is trained in Collaborative Law.
Rachel Murphy
Rachel Murphy is a solicitor in the firm of LK Shields and practices primarily in the area of family law. Rachel’s experience covers all areas of family law including judicial separation, divorce, multi jurisdictional issues on marital breakdown, child abduction, guardianship, custody and access. She is a board member of the Association of Collaborative Practitioners and is chairperson of the Dublin Practice Group of Collaborative Practitioners. Rachel is also a member of the Family Lawyers Association and DSBA family law and minors committee.
