A special workshop will be held to debate and discuss the development of alternative dispute resolution (“ADR”) in resolving family law matters. This seminar will include a discussion of traditional co-operative negotiation between solicitors, resolution of matters through Deed of Separation, Collaborative Practice and recent developments in Family Lawyer Mediation.

Rachel Murphy of LK Shields, a collaborative practitioner, will give insight into the development of Collaborative Practice in Dublin and the work carried out by the Dublin practice group.

Jennifer O’Brien, solicitor Mason Hayes+Curran will talk on Family Lawyer Mediation and Resolution Family Lawyer Mediation training which is now being provided through the DSBA. Jennifer completed the six day mediation training programme in 2009 (completed by 32 family lawyers in total) and she will present an overview of the course, the structured approach adopted and developments to date, in the practice of family lawyer mediation. An outline of the new DSBA precedent Deed of Separation will be presented by Mary Hayes Solicitor of Gore & Grimes. The precedent Deed of Separation has undergone revision and amendment to take account of recent legal developments and the ongoing requirements of family law clients and their advisors.

The forum will be chaired by Josepha Madigan, solicitor and Resolution trained mediator.
Participants at the workshop will each be given the new DSBA precedent Deed of Separation.

Participants will also be given an opportunity to join in the discussion regarding development of ADR in family law in Ireland.

SPEAKERS
RACHEL MURPHY

Rachel is a solicitor in the firm of LK Shields and practices primarily in the area of family law. Rachel’s experience covers all areas of family law including judicial separation, divorce, multi jurisdictional issues on marital breakdown, child abduction, guardianship, custody and access.
Rachel is a board member of the Association of Collaborative Practitioners and is chairperson of the Dublin Practice Group of Collaborative Practitioners. Rachel is also a member of the Family Lawyers Association and DSBA family law and minors committee.

JENNIFER O'BRIEN
Jennifer is a partner in Mason Hayes+Curran, She is a family lawyer with considerable experience in separation, divorce & non-marital matters, as well as cases concerning recognition of foreign divorce, child abduction & enforcement of orders throughout the member states. She is a collaborative lawyer and a Resolution trained mediator. She is the current chair of the Family Law & Minors Committee, Dublin Solicitors Bar Association

MARY HAYES
Mary qualified in 1983 and is a partner with the firm Gore & Grimes Solicitors. She has over 20 years experience in family law practice and heads that department with her firm. She has lectured extensively in the area and made many media appearances

JOSEPHA MADIGAN
Josepha is a partner in Madigan’s Solicitors, She qualified in 1997 and specialises in family law and civil litigation. She has a diploma in arbitration and is a family lawyer mediator. She is a member of the Family Lawyers Association. She is a collaborative law practitioner also and a member of ACP. She acts on behalf of The Legal Aid Board on the private practitioner’s panel in both the District Court and Circuit Court.
