An increasing number of civil and commercial disputes are now resolved through mediation. Advising and representing clients in the mediation process has become an important area of practice for many solicitors. ICMA, the Irish Commercial Mediation Association, with the financial support of DSBA and others, has produced a short film as a tool for training the business community and their professional advisers, including solicitors and others on how mediation works in practice for business and other disputes. Chaired by The Hon Mr Justice Paul Gilligan, this seminar will view the film and hear from some of those involved in its production, on the roles of the mediator, the parties and their representatives, followed by questions and answers.
SPEAKERS
Austin Kenny, Mediator, Forensic Accountant and Business Consultant
Austin is a CEDR accredited mediator (2004), an MII Practitioner Member (2009) and has completed his study of advanced mediation with MATA (2008). He is also an accredited Conflict Management Coach (2010). Since 2005 Austin has mediated a significant number of commercial disputes in a wide range of disputes and business sectors. He is Chairman of the Irish Commercial Mediation Association (ICMA). He was Managing Partner of a mid-tier Accountancy and Business Consultancy Practice for 20 years. He has significant expertise and experience across a rich portfolio of professional financial, accounting and business related services.
Helen Kilroy, Mediator and Partner, McCann FitzGerald, Solicitors.
Helen practices in commercial litigation, mediation and related advisory work. She has wide ranging experience in corporate disputes in particular shareholder disagreements and breach of warranty claims; insurance disputes in particular professional negligence claims and property disputes including landlord & tenant claims. Helen is an accredited CEDR mediator (Centre for Effective Dispute Resolution London) and has significant experience in mediating commercial disputes covering a broad range of subject matter. She is a Council member and immediate past Chairperson of the Irish Commercial Mediation Association. She is a member of the Irish Sports Council's Disciplinary Appeals Board. Helen also lectures on the Law Society Professional Practice course.
Joe Kelly, Mediator and Partner at A & L Goodbody, Solicitors
Joe Kelly is a Partner in the Firm’s Litigation and Dispute Resolution Department. He has developed a strong litigation practice in the Commercial Court and leads the Specialist Corporate Criminal Offences group. He is a fellow of the Chartered Institute of Arbitrators, Irish Branch, and is a practising Arbitrator. He is a founder member of the Irish Commercial Mediation Association and is a practising Mediator, having been involved in over 35 Mediations to date.
