Colm Curran will describe the process for achieving judgment in cases which go by default - i.e. judgment is obtained in the court office without the need for a court hearing. I will also describe what happens when a case is defended in each instance and where a court hearing of some sort is required. Finally Colm will give some general pointers on the types of defences commonly encountered and typical delays which one may expect.

The seminar is intended to provide a general outline of remedies available to enforce a judgment, their origins and the circumstances in which they might be invoked. In the seminar Eoin Morris will commence with the identification of the various forms of enforcing a judgment and the root of their power in law and in equity. The origins of the enforcement of judgments: The “legal” remedies and their origins, The Sheriff, Orders for Possession, Sequestration, Charging Orders, Attachment and Committal, Garnishee proceedings, The registration and enforcement of a Judgment as a Judgment Mortgage, Bankruptcy. The “equitable” remedies and their origins, Equitable Execution: The appointment of a receiver by way of Equitable execution. The enforcement of judgments obtained in European Member States other than Ireland. It will also identify the various types of Defendants in which the above methods of enforcing a judgment are applicable. Eoin will then identify Orders that may be made in aid of execution.

COLMAN CURRAN
Colman is Head of the dedicated Debt Recovery Department and represents government, banking and B2B clients extensively. He advises in relation to both domestic Irish and international debt collection strategies. His areas of Expertise are Banking debt litigation
Government debt litigation, Corporate debt litigation, Enforcement of Judgments, Bankruptcy, Forced Sales, Enforcement of foreign debts, International recoveries
Colman has successfully tendered for volume collections work on behalf of the Irish Revenue Commissioners and has negotiated Mason Hayes & Curran's membership of the Total Credit Management Group (TCM) which is the pre-eminent international collections association. Colman is the author of a number of publications which deal with collections and related topics, such as the legal recoveries process in Ireland, guidelines for credit controllers on terms & conditions and he provides commercial recoveries training courses for clients in various industry sectors.

Eoin Morris BL
Eoin Morris is a practising barrister on the Dublin and Eastern Circuits. Prior to taking his call to the Bar in 2008, Eoin worked with a number of Dublin law firms, including the debt recovery department of Lavelle Coleman. Eoin has taken his experience with him to the Bar and now practices in the area of debt recovery and commercial litigation. Eoin has a practising interest in these areas and construction law. Eoin is the author of a number of forthcoming articles in those areas.
