After much deliberation and fanfare, the Government finally passed the Defamation Act late last year. It came into effect on 1 January 2010 and represents arguably the most significant ever piece of legislation in this area.
Many practitioners will be instructed by a client seeking recourse for some form of defamation and in times where work is at a premium, it is an area of the law which can be very rewarding. All solicitors who practice or wish to practice litigation should be familiar with this piece of legislation which radically changes the way in which all defamation matters are handled. Of particular significance is the new one year statute. It is also important to bear in mind that it applies not just to libel but also to slander and the many other instances in which defamation occurs.
This seminar is run by the DSBA’s Litigation Committee and we have sourced three of the country’s leading experts in this area. Simon McAleese, Paula Mullooly and James MacGuill have extensive experience and will provide a perspective from both the Defence and Plaintiff side.
Simon McAleese will talk about the Defences set out in the Defamation Act 2009 and how will they impact on defamation practice.
Paula Mullooly will look at procedural changes contained in the 2009 Act and how they will impact on practice.
James MacGuill will present a perspective from the point of view of the Plaintiff.

SPEAKERS
Simon McAleese
Simon McAleese is the Managing Partner of Simon McAleese Solicitors. Simon acts for a number of domestic and international media organisations. His practice is largely focused upon media defence work and his clients include print, broadcast and electronic media.
Paula Mullooly
Paula is a Partner at Simon McAleese Solicitors. She advises Irish and international clients on Media Law. Paula has acted in some of the most high-profile media litigation in this jurisdiction including the first Irish media law case to be brought before the European Court of Human Rights.
Paula was a Government appointed member of the Working Group on Defamation. The Group advised the Government on the Heads of a Defamation Bill to reform the Law of Defamation in Ireland. She is also Chairman of the Censorship of Publications Appeals Board.
James MacGuill
James MacGuill is the principal of MacGuill & Co, Solicitors. He is a recent president of the Law Society and one of country’s best known solicitors. He has acted for many Plaintiffs in defamation cases and has regularly represented his clients as well as his profession in both the print and broadcast media.
